The Bad Stuff, Inc. (sometimes referred to as “we,” “us” and “our”) understands the importance of protecting your personal information. This privacy policy (“Privacy Policy”) describes the types of information we may collect from you or that you may provide when you use this website or other online services we provide (collectively, the “Platform”), our practices regarding collection of your personal information, and how we will treat it.  


Information We May Collect About You and How We Collect It


We may collect several types of personally identifiable information from and about you including the following:

  • Full name
  • Email address
  • Phone number
  • IP address


Collectively, the information described above and any other personally identifying information we may collect from you shall be referred to as “personal information.” We may collect personal information:

  • Directly from you if and when you provide it to us, including through the contact page on the Platform and when you sign up for updates about products and events; and
  • Automatically as you navigate through our Platform through cookies and other automatic forms of data collection. Personal information collected automatically may include usage details, IP addresses and other information collected through automatic processes.


We ask that you do not send us or disclose any sensitive personal information on or through the Platform or otherwise. Such sensitive information includes racial or ethnic origin, religion or other beliefs, political opinions, health, criminal background or trade union membership. 


Information We Collect through Automatic Data Collection Technologies


As you navigate through and interact with the Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including:

  • Details of your visits to the Platform, including traffic data, logs and other communication data and the resources that you access and use on the Platform; and 
  • Information about your computer, mobile device and internet connection, including your IP address, operating system, and browser type.


The information we collect automatically is intended to be statistical data and may include personal information. It helps us improve the Platform, deliver a better and more personalized service, and ensure the Platform is secure and safe to use. Please see the section below titled “How We Use Cookies and Similar Technologies” for more information about our use of cookies.


California Business & Professions Code Section 22575(b) provides that California residents are entitled to know how we respond to “Do Not Track” browser settings or signals. We do not currently take actions to respond to “Do Not Track” signals. It is our view that a uniform technological standard has not yet been developed. We may adopt a standard once one is created. 


Information We Collect from Third Party Sources


We may also collect information about you from publicly and commercially available sources, as permitted by law, which we may combine with other information we receive from or about you. 


How We Use Your Personal Information 


We use information that we collect about you or your devices:

  • To present the Platform and its content to you;
  • To provide you with information, products or services that you request from us;
  • To invite you to register for events;
  • To fulfill any other purpose for which you provide it;
  • To notify you about changes to the Platform or any products or services we offer or provide through it;
  • To maintain and manage your account;
  • To conduct research on our users’ demographics, interests and behavior;
  • To perform analyses or for other purposes to improve the quality of the Platform and our business;
  • To monitor for fraud and security purposes, for example, to detect and prevent cyber attacks;
  • To publish our own marketing and promotional materials;
  • To provide you with offers and information about the Platform and our affiliates;
  • To deliver targeted advertising, promotions and offers, on behalf of ourselves and advertisers, on and off the Platform;

We may disclose personal information that we collect or you provide to third parties, including:

  • To contractors, service providers and other third parties we use to support the Platform and our services and who are bound by contractual obligations to keep your personal information confidential;
  • To a buyer or other successor in the event of a merger, divestiture, consolidation, restructuring, reorganization, dissolution or other sale or transfer of some or all of our business or assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by us about users is among the assets transferred. In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy;
  • To our affiliates and business partners;
  • To third parties that provide advertising, content or functionality, or who analyze ad performance, on the Platform or other websites or platforms;
  • To fulfill the purpose for which you provide it;
  • To publish our own marketing and promotional materials, including as provided below in the “Marketing” section;
  • If required by applicable law;

  • If we believe disclosure is necessary or appropriate to protect our rights, property or safety and that of our customers or others;

  • With your consent.


When we disclose personal information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.


We do not sell your personal information.


Any third party with whom we are allowed to share your personal information is authorized to use your personal information in accordance with our contractual obligations with such third parties and in accordance with their own privacy policies, over which we have no control. You agree that we are not responsible or liable for any of their actions or omissions.

If you provide personal information about another person to us, you will be representing, and we will believe, that you have the consent of that individual to enable us to collect, use or disclose their information as described in this notice, and will rely on our belief and your representation.


Marketing


We may use your personal information, such as your name, email address, telephone number, etc. ourselves or by using our third party subcontractors for the purpose of providing you with promotional materials concerning our goods or services, which we believe may interest you.  


Out of respect to your right to privacy, we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists. 


Please note that even if you have unsubscribed from receiving marketing emails from us, we may send you other types of important e-mail communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements or administrative notices.


Your California Privacy Rights


Shine the Light Protection

California Civil Code Section §1798.83 permits users of the Platform that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes, if applicable. California Consumer Privacy Act of 2018

The California Consumer Privacy Act of 2018 (the “CCPA”) provides certain consumers with specific rights regarding their personal information. Currently, we do not constitute a “business” as defined and covered by the CCPA. Should that determination change at any time, we will update this Privacy Policy, accordingly.


Age Requirement

You must not provide us with your personal information if you are under the age of 21. We do not intend to collect personal information from, or market alcoholic beverages to, any individuals under the age of 21. If we receive notice or believe that someone under the age of 21 has provided us with personal information, we will make every reasonable effort to remove such personal information from our records, or to flag such personal information and (to the extent permitted by law) retain it for the sole purpose of ensuring that it is no longer used.


We understand the importance of protecting children’s privacy, especially in an online environment. The Platform is not designed for or directed at children. Under no circumstances shall we allow use of our Platform or services by minors. We do not knowingly collect personal information from minors. If a parent or guardian becomes aware that his or her child has provided us with personal information, he or she should contact us at admin@thebadstuff.com.


Data Security

Unfortunately, the transmission of information via the internet is not completely secure. Although we implement reasonable measures to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Platform, or thereafter. Any transmission of personal information is at your own risk. It is important for you to protect against unauthorized access to your computer or mobile device. Be sure to sign-off when finished using a shared computer or mobile device and use other reasonable measures to secure your sensitive information.


Links to Other Websites

We may provide (and permit other parties to provide) links to other websites or resources. Because you acknowledge and agree that we have no control of such websites and resources, we are not responsible for the availability of such websites or resources, and we do not endorse and are not responsible or liable for any content, advertising, products or other materials on or available from such websites or resources. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such website or resource.


Third Party Collection of Information


This Privacy Policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or websites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to. 


This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties which we may disclose information as set forth in this Privacy Policy. 


How We Use Cookies and Similar Technologies

We use cookies to ensure that we give users the best experience on our Platform. We and our trusted partners use cookies and other technologies in our related services, including when you visit our Platform or access our services.


A “cookie” is a small piece of information that a website assign to your device while you are viewing a website. Cookies are very helpful and can be used for various different purposes. These purposes include allowing you to navigate between pages efficiently, enabling automatic activation of certain features, remembering your preferences and making the interaction between you and our Platform quicker and easier. Cookies are also used to help ensure that the advertisements you see are relevant to you and your interests and to compile statistical data on your use of our Platform. 


The Platform uses the following types of cookies:

Cookies do not contain any information that personally identifies you, but personal information that we store about you may be linked, by us, to the information stored in and obtained from cookies. You may remove the cookies by following the instructions of your device preferences; however, if you choose to disable cookies, some features of our Platform may not operate properly and your online experience may be limited.


We also use a tool called “Google Analytics” to collect information about your use of the Platform. Google Analytics collects information such as how often users access the Platform, what pages they visit when they do so, etc. We use the information we get from Google Analytics only to improve our Platform and services. Google Analytics collects the IP address assigned to you on the date you visit sites, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to this Platform is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.


Transfer of Data Outside the European Economic Area


Please note that some data recipients may be located outside the European Economic Area. In such cases, we will transfer your data only to such countries as approved by the European Commission as providing adequate level of data protection, or enter into legal agreements ensuring an adequate level of data protection.


Updates


We reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy Policy. The latest revisions will be effective as of the date first set forth above. Your continued use of the Platform, following the notification of such amendments on the Platform, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.
